These Terms of Service ("Terms") apply to your use of ts-warehouse.com (the "Site") and to purchases you make from TS-Warehouse ("TS-Warehouse", "we", "us" or "our") through the Site. By using the Site or placing an order, you agree to these Terms and to the policies they refer to, including our Privacy Policy, Shipping Policy and Refund Policy. If you do not agree, please do not use the Site.

The Site runs on Shopify, which provides our online store platform and checkout.

1. Eligibility and Accounts

  • You must be at least 18 years old, or the age of majority where you live, to place an order.
  • If you order for a business, you confirm that you are authorized to act for that business, and "you" includes the business.
  • You are responsible for keeping your account sign-in secure and for activity on your account. Tell us right away if you think someone else has used it.
  • Please give us accurate, complete information and keep it up to date so we can process and deliver your orders.

2. Orders, Pricing and Availability

  • Your order is an offer to buy. We accept it when we ship it. An order confirmation email means we received your order, not that we accepted it.
  • We may refuse, limit or cancel any order, including orders that appear fraudulent, exceed quantity limits, or cannot be filled. If we cancel an order after you have paid, we will refund you.
  • Prices are in U.S. dollars and can change without notice. Product availability is not guaranteed until your order ships.
  • We try to show accurate prices, descriptions, images and stock levels. If we find an error, we may correct it and cancel or update affected orders, even after an order is placed. We will contact you before shipping if the price of your order changes.
  • Product images are for reference. Packaging, colors and appearance may vary from what is shown.
  • By submitting payment, you confirm you are authorized to use the payment method, and you authorize us and our payment providers to charge it.

3. Discounts, Promotions and Free Gifts

  • Discount codes cannot be combined with other codes unless we say so. Some products and bundles may be excluded. Codes have no cash value and may expire.
  • Free gifts are offered at the order totals shown on our Discounts and Gifts page. One free gift per order, while supplies last. Free gifts have no cash value and cannot be exchanged.
  • If you return an order that came with a free gift, the gift must be returned too, or the gift's regular price will be deducted from your refund.
  • We may change or end any promotion, discount or free gift offer at any time, and we may cancel promotional benefits obtained through misuse.

4. Taxes

We collect sales tax where required by law. If your business is tax exempt or buying for resale, contact us with a valid exemption or resale certificate before you order. Taxes charged on past orders are generally not refunded because an exemption certificate was provided later.

5. Shipping and Delivery

Shipping methods, costs, cutoff times and delivery areas are described in our Shipping Policy. Delivery dates are estimates. We are not responsible for carrier delays or delays caused by weather or other events outside our control. Please inspect your order when it arrives and tell us about any damage or missing items right away. Some items, such as hazardous materials, flammable liquids and aerosols, can only ship by certain methods and to certain locations.

6. Returns and Refunds

Returns and refunds are covered by our Refund Policy, which includes items that cannot be returned, such as mounted tires, closeout items and hazardous materials.

7. Product Information, Safety and Installation

  • Product descriptions, specifications and fitment information come largely from manufacturers. You are responsible for confirming that a product is right for your vehicle, equipment or use before you buy and install it.
  • Always follow the manufacturer's instructions, warnings, load and pressure ratings, and torque specifications. Tires, wheels, TPMS sensors, lug nuts, lifts and shop equipment should be installed and serviced by a qualified technician.
  • Safety Data Sheets, manuals, spec sheets, flyers and other product documents on the Site are provided by manufacturers for your convenience. We do not guarantee that they are the latest version. Check with the manufacturer if you need to confirm current information.
  • Some products carry California Proposition 65 or other safety warnings. Read all warnings and labels before use.

8. Warranties

Many products come with a warranty from their manufacturer. Those warranties are provided by the manufacturer, not by TS-Warehouse, and we will help you contact the manufacturer when we can. Except for manufacturer warranties and anything we state in writing, and to the fullest extent allowed by law, the Site and all products are provided "as is" and "as available", and we disclaim all other warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. Some states do not allow limits on implied warranties, so some of these limits may not apply to you.

9. Limitation of Liability

To the fullest extent allowed by law, TS-Warehouse and its owners, employees, agents, suppliers and service providers will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or business, arising from your use of the Site or any product, even if we were told such damages were possible. Our total liability for any claim related to the Site or a product will not be more than the amount you paid us for the product that is the subject of the claim. Some states do not allow these limits, so they may not fully apply to you.

10. Indemnification

You agree to defend, indemnify and hold harmless TS-Warehouse and its owners, employees and agents from claims, losses and expenses, including reasonable attorneys' fees, arising from your breach of these Terms, your misuse of the Site or a product, or your violation of any law or the rights of others.

11. Using the Site

You may use the Site only for lawful purposes. You may not:

  • Break any law or regulation, or help anyone else do so.
  • Give false or misleading information, or pretend to be someone else.
  • Upload viruses or harmful code, or interfere with the Site's security or operation.
  • Scrape, crawl or copy the Site or its content with automated tools, or collect other people's personal information.
  • Harass, threaten or abuse anyone, or post unlawful, offensive or infringing content.

We may suspend or end your access to the Site if you break these Terms.

12. Intellectual Property

The Site and its content, including text, images, logos, product descriptions and the TS-Warehouse and Premium Service names and marks, belong to us or our licensors and are protected by law. You may not copy, reproduce or use them without our written permission, except to view the Site and shop with us. Other brand names and trademarks belong to their owners.

13. Feedback and Submissions

If you send us ideas, suggestions, reviews or other feedback, you allow us to use them without payment or obligation to you. You are responsible for anything you send us and confirm that it does not violate anyone's rights.

14. Third-Party Sites and Services

The Site may link to or use services from other companies, such as payment providers, carriers and manufacturers. We are not responsible for their content, products or practices, and your use of them is subject to their terms. If you buy our products on Amazon, eBay or Walmart, that marketplace's terms also apply to your purchase.

15. Privacy

Our Privacy Policy explains how we collect, use and share personal information.

16. Changes to the Site and These Terms

We may change, suspend or discontinue any part of the Site at any time. We may update these Terms by posting a new version on this page and changing the "Last updated" date. The Terms in effect when you place an order apply to that order. Continuing to use the Site after an update means you accept the updated Terms.

17. Governing Law and Disputes

These Terms are governed by the laws of the State of Minnesota, without regard to its conflict of law rules. Any dispute related to these Terms, the Site or a purchase will be brought in the state or federal courts located in Dakota County, Minnesota, and you agree to the jurisdiction of those courts. Before filing a claim, please contact us so we can try to resolve the issue informally.

18. General

  • If any part of these Terms is found unenforceable, the rest stays in effect.
  • If we do not enforce a right, we have not waived it.
  • These Terms and the policies they refer to are the entire agreement between you and us about the Site and your purchases, and replace any earlier versions.
  • You may not transfer your rights under these Terms without our consent. We may transfer ours, for example if our business is sold.
  • We are not responsible for delays or failures caused by events outside our reasonable control.
